IIED (Intentional infliction of emotional distress)

Some of the professors put on a mock trial for us regarding this subject.


Can you sue someone for IIED, intentional infliction of emotional distress, just because of an insult? Does there have to be physical contact in order to sue for emotional damages?

Well according to Florida courts, if the words are intended to, and severe enough to cause a reasonable person emotional distress, then yes.

If the words are not severe enough but still cause emotional distress because the person being insulted is super sensitive, they prob won't win a case because those words would not cause a reasonable (normal) person emotional distress.
